What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is a fresh start involving the elimination of all or a portion of your debt (including medical bills, credit card bills, unsecured loans, payday loans and more). Certain debts cannot be eliminated, such as child support, student loans and most taxes. Filing bankruptcy immediately stops all collection proceedings against you. Most individuals are concerned with keeping their home, vehicles and other personal property. Generally, as long as there is little equity and the loan payments are current, you will be allowed to do so. The cost associated with filing a Chapter 7 bankruptcy are court filing fees, credit counseling fees and attorney fees.
What is Chapter 13 Bankruptcy?
Chapter 13 bankruptcy is a consolidation or repayment plan for individuals with regular income. We help you establish a repayment plan for your creditors that lasts up to five years. A set payment is established and is paid to a Chapter 13 Trustee who distributes payments to your creditors. Chapter 13 helps individuals with regular income get back on track and keep their property. A Chapter 13 can be started for just the court filing fee and credit counseling fees. Attorney fees, which are set by the court, are paid through the repayment plan along with creditors.
